Terms of Service
(Last updated: September 2026)
This document is governed by German law. This English version is provided for your convenience.
1. Scope
These Terms of Service govern the use of the application Goodterm (hereinafter "Service") in its web and app editions.
2. Provider
Lukas Wunderlich
Altdorferstraße 3a
93049 Regensburg
Germany
Email: hello@goodterm.net
3. Service Description
Goodterm is an application for creating, managing, and searching notes. It uses Artificial Intelligence for text processing, generation, and analysis, as well as for meaning-based search.
For this purpose the service integrates external AI systems, in particular the Gemini API from Google. AI functionality is an essential component of the service.
The service is currently provided free of charge. There is no entitlement to any particular scope of functionality.
4. Registration and User Account
4.1 Registration
Use of the service requires an account. Complete and truthful information must be provided during registration. Sign-in is possible with an email address and password or via a Google or GitHub account.
4.2 Minimum Age
Goodterm is intended exclusively for adults aged 18 and over. Persons under 18 may not use the service, including with parental or guardian consent.
4.3 Account Security
The user is responsible for keeping their login credentials confidential. Sharing login credentials with third parties is not permitted. Active sessions can be reviewed and revoked in the settings.
4.4 Suspension and Deletion
The provider reserves the right to suspend or delete user accounts in case of violations of these Terms of Service. Users can delete their account themselves at any time.
5. Use of AI Features
5.1 How It Works
When using AI features, the relevant inputs and content are transmitted encrypted to Google and processed there; the results are transmitted back. Details are set out in the Privacy Policy.
Google does not use the content on the paid tier for general product improvement. Abuse prevention may involve temporary retention, human review of flagged content and use for models that enforce usage policies; details are provided in Section 6.3 of the Privacy Policy.
5.2 No Warranty for AI Results
AI-generated content may be erroneous, incomplete, or unsuitable. The provider assumes no warranty for:
- the accuracy of AI-generated texts,
- suitability for a particular purpose,
- freedom from third-party rights.
The user is obligated to independently review AI-generated content before use. This applies particularly to:
- legal, medical, or financial information,
- factual claims and source references,
- content for publication or commercial use.
5.3 Transparency
AI contributions are marked as such in the interface; changes made by connected AI agents are labelled in the change history.
If the user copies AI-generated text into their own content, no technical marking is applied. Publishing such content may trigger labelling obligations for the user, in particular under Art. 50 of Regulation (EU) 2024/1689 (AI Act). Compliance with these is the user's responsibility.
6. Rights in Content
6.1 User Content
The user retains all rights in the content they submit. The provider receives only the rights technically necessary to provide the service: to store and process the content and to transmit it to the service providers named in the Privacy Policy.
The user warrants that they hold the necessary rights in the content they submit.
6.2 AI-Generated Content
AI-generated content is generally not protected by copyright under applicable German law, as there is no personal intellectual creation within the meaning of § 2(2) UrhG (German Copyright Act).
The user receives a simple right of use for content generated for them. No transfer of copyright takes place insofar as none arises.
Note: AI-generated content may unintentionally reproduce third-party works. The user bears the responsibility to check before publication whether third-party rights are affected.
6.3 Data Backup
The provider creates backups to protect the overall system. These do not replace the user's own data backups. The provider is liable for loss of content only as set out in section 9.
7. Connecting External AI Agents
Users can connect external AI applications to their account and grant them permissions to create, read, modify, and delete notes. These permissions are disabled by default and take effect only upon explicit authorization. Create permission is granted independently; modify includes read, and delete includes modify and read.
In doing so, the user decides on their own responsibility to disclose their content to the provider of the respective application. The provider assumes no responsibility for that application's conduct or data processing. Granted read, modify, and delete permissions apply to unprotected notes in the account outside the trash. AI-protected notes and Goodterm chats are excluded from this access. Only the user can change AI protection. Deletion by an agent moves a note to the trash. Authorizations can be revoked at any time.
8. Prohibited Use
Use of Goodterm is prohibited for content that:
- violates applicable law or third-party rights,
- is discriminatory, offensive, pornographic, or glorifies violence,
- serves to spread malware or spam,
- aims to manipulate or abuse the AI system,
- is intended to generate misleading or fraudulent information.
Also prohibited are actions that impair operation, in particular circumventing technical protection measures and automated bulk querying beyond what normal use requires.
9. Liability
9.1 Unlimited Liability
The provider is liable without limitation for damages arising from injury to life, body, or health, as well as for damages based on intentional or grossly negligent conduct.
9.2 Limited Liability
In case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the typical, foreseeable damage.
9.3 Exclusion of Liability
Any further liability is excluded. Use of AI-generated results is at the user's own risk.
9.4 Availability
The provider strives for high availability of the service but cannot guarantee it. Maintenance work, disruptions at upstream providers, and outages of the integrated AI services may lead to temporary limitations.
10. Data Protection
Processing of personal data takes place in accordance with our Privacy Policy.
11. Term and Termination
The usage relationship is concluded for an indefinite period. Either party may terminate it at any time without giving reasons; the user by deleting their account.
Should the provider discontinue the service permanently, this will be announced with reasonable notice so that content can be exported.
12. Amendments
The provider reserves the right to amend these Terms of Service with effect for the future. Users will be notified of changes. If the user does not object within six weeks or continues to use the service, the changes are deemed accepted; the notification will point out this consequence separately.
13. Final Provisions
13.1 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.
13.2 Severability Clause
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
